Here at Cruiz-N Machines, we pride ourselves on providing engine packages and components that are tried, tested and reliable. In fact, we've built our reputation on helping people go very fast, very reliably.
All that being said, there are many variables that contribute to engine and component reliability once it leaves our shop. It's no secret that these components get pushed hard! Things like installation configuration, tuning and setup adjustments, and how an engine and its components are driven contribute to the reliability of an engine.
We make every effort to take great care of our customers and are confident that we are always more than fair. However, because of those variables, the intended use of these products, and the conditions to which these products are exposed, we are not able to offer warranties or guarantees (performance, reliability or otherwise) on our engines or parts. In addition to our custom components, we typically include components from individual third-party / OEM manufacturers which may have OEM-provided warranties. If warranty services are required on these individual components, then the end-user is responsible to work directly with the third-party OEM suppliers to resolve any issues.
Warranty and Legal Information
Each Cruiz-N Machines engine, part or assembly is sold "as is", "where is", "with all faults", and without any express guarantees or warranties whatsoever. To the greatest extent permitted by state and Australian law, Cruiz-N Machines disclaims all express and implied warranties including, without limitation, the warranties of merchantability and fitness for a particular purpose; regardless if a particular purpose is identified in association with the Cruiz-N Machines engine and or part including, without limitation, any sales literature or as a result of representations made by Cruiz-N Machines or any party selling or providing Cruiz-N Machines engine and or parts.
Cruiz-N Machines expressly disclaims all liability for direct, indirect, special incidental, punitive, or consequential damages (regardless if Cruiz-N Machines has been notified of the possibility of such damage), including, without limitation, injury to persons including death; damage to or loss of property or equipment; cost of labor; loss of profits, winnings or revenue; cost of purchase, cost of substitute products or replacement of goods; the cost of Cruiz-N Machines engine and or parts or any vehicle components or parts affected by the Cruiz-N Machines engine and or parts; down time costs; claims of buyer's end users for such damages that were in any way derived or resulted from the recommendation, installation or use of Cruiz-N Machines engine and or parts.
Because race vehicle manufacturing, preparation and testing, and high performance vehicles in general, are inherently dangerous activities that may cause serious bodily injury and/or death to those who use such products and/or participate in such activities, in no event shall Cruiz-N Machine's liability, whether if arising in tort (including negligence or strict liability), contract or otherwise exceed the cost of the Cruiz-N Machines engine and or part. If a Cruiz-N Machines engine and or part proves defective following its purchase, the buyer and not Cruiz-N Machines, the manufacturer, distributor, or retailer shall be solely responsible for all costs incurred to service or repair the defective Cruiz-N Machines engine and or part.
The end-user is solely responsible and assumes all risks associated with the performance of the engine and or part. No Cruiz-N Machines engine and or part is certified under Australian vehicle safety standards or Australian Design Rules regulations. Therefore, Cruiz-N Machines engines and or parts are not certified for use on public roads and are deemed race/competition/off-road engines only.
Governing Law
These Cruiz-N Machines Consumer Terms and Conditions of Sale, and all sales of Products and or services by Cruiz-N Machines to consumers, shall be governed by the laws of the state of Queensland, Australia. Any litigation which may be deemed necessary on behalf of either party involved must and will be filed in a Brisbane based court.
Emissions and Other Requirements
National/federal, state or local laws, rules and regulations in Australia or elsewhere may prohibit the removal or modification of components that were installed on motor vehicles or engines by the original equipment manufacturer in order to meet emissions requirements or to comply with safety regulations applicable to engines or vehicles manufactured for use on public roads. Removal of such components may be illegal and considered to be emissions-related tampering under applicable laws, rules and regulations.
Compliance with such laws, rules and regulations are the obligation of the purchaser or vehicle owner. Cruiz-N Machines disclaims any and all responsibility.
VEHICLE BUILD ENGINEERING & REGISTRATION REQUIREMENTS
For Queensland & The Other State's Engineering & Approval Process we go through to build these cars is a very strict process called an ICV.
All of our vehicles are built under Rules & Regulations of an ICV (Individually Constructed Vehicle)
This gives the option for Full Unrestricted Registration in the State of Compliance.
We build these vehicles in Queensland and work with a Queensland based Engineer for Approval & ADR Compliance. This is why we say our builds are stated to be *Registerable in Queensland (*Provided the rules do not change by the governing bodies, this obviously out of our control)
For the other States & Territories in Australia. The rules and regulations are the same or very similar, however we have heard stories that some people within certain governing bodies have made it difficult for ICV's to be approved in some other states.
If you find it difficult for registration in other states, it may be necessary to have your build registered in QLD initially, before *transferring to another state (*if at all possible)
In other cases we have had many builds go through the process in other States to be fully registered without any issues at all for full registration.
We follow these strict Rules & Regulations of ICV & ADR Compliance with every build we do. Working with the best Automotive Engineers in the business from Start to Finish. With every effort humanly possible to make sure your build is safe, reliable and fully compliant for ease of Vehicle Registration in *Any State (*if possible)
However if the ICV Rules change or any of the required ADR's change before, during or after the build, it may be required to change direction.
This may incur additional costs for testing or create unforseen issues.
This may even result in the possibilty of your build NOT being able to be registered at all? However unlikely this is, the rules have been the same for many years and we do have great engineers onboard to get these builds through the system for us. # This is a buyer beware situation.
